HOW IT WORKS

PETITION:

The first papers to file with the court is a Petition, which is a kind of "wish list" along with some factual information. The Petition tells the court what kind of case it is (i.e., divorce, legal separation, or nullity), says what the important facts are about the relationship (dates, children, or property), and tells the court what you are hoping to get at the end (support, property division, or orders about custody). There are other forms to file as well, describing property, details about the children's histories, or specific requests you might have, depending on the particular facts of the case. Once you have reviewed and approved the documents we will e-file or fax file your documents with the appropriate family law court.

SERVICE:

California law requires that the Respondent, your spouse, is served with the filed Petition and your financial disclosures, and it involves some very specific forms. If you proceed by default, without any agreement, only the Petitioner must complete Disclosure, but if both parties have filed paperwork in the case, or you have a written Marital Settlement Agreement (MSA) to submit with the judgment, both parties are required to file Declarations that they have completed Disclosure. The manner in which the documents are served must follow the California Code of Civil Procedure. If the parties are working cooperatively, we can complete the service of the documents by mail and file a proof of service at the court.

JUDGEMENT:

Few cases require a formal trial; most are resolved by default or by agreement, with or without a default. When the parties agree on all issues, they submit a proposed judgment with their agreement attached. If there are no issues and the other party does not respond, the Petition may proceed alone and obtain a judgment. The proposed judgment and accompanying papers can be submitted with a Declaration for Default, or the Petitioner can request a hearing, and present the judgment at the hearing. The Judgment is a final decision. The Judgment will also say the date that the parties are made single. If we prepare the final judgment documents for you, regardless if the case is proceeding by default, with an agreement, or wrapping up after a hearing, we will continue to monitor the case with the court to ensure it is moving through the court system as expected. In some cases the court will require adjustments or additions to the file before the Judge will sign. The court classifies these as "rejections", but it is simply a request for adjustments. Don't worry, our flat fee includes any requests for additional documents or adjustments on submitted ones.

Process 

The documents are completed in your name as a self-representing party and you will make any court appearances should that become necessary. The attorney's name does not appear on your documents and they are not your attorney of record. You will remain 100% self-representing and you are responsible for making any court appearances should that be necessary. When you come in for your initial consultation with Adame paralegal services, you will meet with our paralegal and very briefly with the family law attorney, who will answer your questions and listen to your concerns about your divorce, then offer you legal advice.

The paralegal cannot provide legal advice in the state of California. In order for a paralegal (us) to assist a member of the public (You), they are required to be supervised by an attorney. A supervising attorney will represent you in a limited capacity for the soul purpose of providing legal advice and to supervise your document preparation as well as final review of all documents to be submitted to the court.
